UK Visa Administrative Review

If your visa application has been unsuccessful, you may be able to apply for an Administrative Review of the Home Office decision. In these cases, it’s crucial to work with experienced immigration lawyers who will be able to help you clearly point out which errors we believe have been made. Administrative Review eligibility

If you have received a negative decision for your visa application, and the refusal letter states that you can ask for the decision on your visa to be reviewed, you may be eligible for an Administrative Review.

An Administrative Review allows an applicant to request another consideration of their visa application if they believe that the refusal was a result of a case working error. This means the case will be reviewed by a new Home Office worker and, if an error has been made, it will be corrected and the decision on the visa application updated accordingly.

If you are in the UK

You may ask for a review if either:

  • Your visa application was refused
  • Your visa was granted, but you are unhappy with the amount or conditions of your leave

If you are not eligible for a review, you may still be able to appeal your visa decision.

If you are outside the UK

You may be eligible for a review if you meet all of the following requirements:

  • Your visa application was made from outside the UK
  • You received a refusal on or after 6 April 2015
  • You do not have the right to appeal against the refusal
  • You did not apply as a short term student or visitor (except as a healthcare visitor)

Applying for an Administrative Review

All applications are made online. If you are applying from inside the UK, you have to apply within 14 days of receiving the Home Office’s decision. If you are applying from outside the UK, you have 28 days.

An Administrative Review costs £80 and it currently can take up to 6 months or more for the Home Office to make a decision. You should receive an update after 3 months if you have not yet heard back from them.

You may have to provide new evidence as part of the request to review your case. This will only be if the Home Office requests new evidence. If they do, you will have 7 working days to submit the requested evidence. Unless the review uncovers new reasons for your visa refusal, you may only apply for an Administrative Review once.
