  • From 1 October 2026 the Right to Work Scheme also covers worker’s contracts, individual subcontractors and online matching services, so civil penalty liability can reach beyond the direct employer.
  • The March 2026 sponsor guidance replaced “genuine vacancy” with “eligible role”, and a licence can now be refused or revoked on reasonable suspicion of unsuitability.
  • The Sponsor Management System now requires multi-factor authentication, and new Level 2 Users can no longer be appointed.
  • Using the wrong right to work check removes your statutory excuse entirely. Compliance is continuous, not something reviewed at renewal.
